Job Description

Job Summary

Under direction of the Director IV of the Legal Service, and with considerable latitude for the exercise of independent judgment, heads the Legal Service Division engaged in varied and complex work pertaining to the provision of legal services for the PPP projects and internal operation of the PPP Center; assumes the supervisory functions of higher level supervisors in their absence; and does other related work that maybe assigned from time to time.

  • Plan, program, and distribute works, review and evaluate the performance of employees, and maintain morale and discipline among employees.
  • Provids legal advice and assistance on PPP projects and contracts and other related documents including screening, negotiation and verification of projects, and also in the monitoring and enforcement of PPP projects.
  • Prepare and/or review contracts, agreements, transaction documents, and other related documents under the Build-Operate Transfer Law, the Government Procurement Reform Act and other related laws.
  • Review contracts and transaction documents prepared by Technical Advisors/Consultants for PPP projects.
  • Prepare legal opinions/comments/advice relative to PPP project development and/or facilitation and assistance.
  • Provide legal advice on operational matters.
  • Provide legal advice and assistance to all Services of the PPP Center in the performance of their mandated functions, roles and responsibilities.
  • Review internal documents, issuances, communications and other related documents of the PPP Center and its officials and employees.
  • Provide legal advice/assistance to the PPP Center and PPP Center officials and employees.
  • Assess potential litigation arising from contract variations.
  • Conduct legal research and specialized studies.
  • Monitor laws, administrative issuances, court decisions, and other legal issuances relative to PPP programs and projects.
  • Maintain close supervisory direction to ensure accomplishment and implementation of the Division’s mission and functions.
  • Attend meetings/conferences within and outside PPP Center.

Minimum Qualifications

Education: Bachelor of Laws
Experience: 3 years of relevant experience
Training: 16 hours of relevant training
Eligibility: RA 1080 (BAR)

Knowledgeable of the following subjects:

  • BOT Law, Government Procurement Act, and other related laws; Administrative Law, Civil Service rules and regulations, and other pertinent issuances; and Government contracts

Demonstrated ability in the following areas:

  • Supervisory/managerial experience;
  • Legal research and problem solving;
  • Negotiation;
  • Facilitation and presentation delivery;
  • Due diligence audit experience;
  • Experience in commercial transactions; and
  • Other skills analogous to the foregoing.

About Public-Private Partnership Center of the Philippines

Under the Presidency of Benigno Simeon C. Aquino III, public-private partnership was tagged as a powerful machinery to help push forward the country’s development. Under his administration, private sector participation in the country’s economic agenda is clearly defined in his “social contract” with the Filipino people. The Public-Private Partnership Center of the Philippines is the sole body tasked to facilitate and coordinate the country’s PPP program. Part of its task is to manage a revolving fund called the Project Development and Monitoring Facility. At the same time, the PPP Center provides Implementing Agencies (IAs) technical advisory support in project development and management and monitors the implementation of PPP priority projects. Also part of its task is to formulate policy guidelines for PPP transactions, and develop and manage a central database of all PPP programs and projects.
